Nebius AI data center campus, EastGate Commerce Center
Nebius is building an AI campus of at least 800 MW on about 400 acres in Independence's EastGate park, after a 5-2 council vote on Chapter 100 incentives that was followed by a failed referendum effort, a recall and a pending lawsuit. Also known as: Nebius Independence, Missouri ADC Holdings.
Who is behind it
The record, newest first
A hearing was scheduled in Jackson County Circuit Court on the plaintiffs' restraining order request and the defendants' motion to dismiss. (KSHB 41, Oct. 8, 2026; FOX 2 (Nexstar), Oct. 7, 2026)
First District voters recalled Councilman John Perkins, who had voted for the incentives, with about 68% voting yes. (KCTV5, July 8, 2026; KCTV5, Sept. 1, 2026)
The Independence GUARD Alliance and residents filed a 16-count suit in Jackson County Circuit Court against the city, the Nebius subsidiary Missouri ADC Holdings LLC and Independence Power Partners, alleging zoning, Sunshine Law and charter violations and seeking a restraining order. The city said it disagrees with the suit's characterization and believes the approvals were lawful; Nebius said it is reviewing the claims and is committed to complying with the law. (KSHB 41, Aug. 13, 2026)
The council voted 7-0 for a 180-day moratorium on new data center and battery storage applications; projects already approved, including Nebius, are not affected. (KCTV5, July 8, 2026; City of Independence, July 2026)
Nebius broke ground on the campus (KCTV and KSHB say May; another KSHB story says the first phase began in April). (KCTV5, July 8, 2026; KSHB 41, Oct. 12, 2026; KSHB 41, Oct. 8, 2026)
Opponents turned in about 4,865 signatures anyway as a show of opposition, per the Kansas City Star. (The Kansas City Star (via AOL), April 3, 2026)
Jackson County Circuit Judge Jennifer Phillips ruled for the city, finding the ordinance took effect immediately and was not subject to referendum, which ended the bid for an August vote. (KSHB 41, March 25, 2026)
The city rejected opponents' referendum petition, saying its charter exempts an ordinance tied to a contract and bonds that takes effect immediately; residents sued on March 9. (KSHB 41, March 10, 2026)
After a public hearing of nearly four hours, the council voted 5-2 to approve Chapter 100 bonds and tax abatement for the campus. (City of Independence, Dec. 16, 2025; KSHB 41, March 3, 2026; KSHB 41, March 10, 2026; DatacenterDynamics, March 4, 2026)
The city's FAQ (dated Dec. 16, 2025, later updated) described at least 800 MW of demand, up to four buildings and power from a privately financed plant at the Blue Valley site. (City of Independence, Dec. 16, 2025)
Nebius closed on about 398 acres in EastGate Commerce Center, bought from NorthPoint Development. (DatacenterDynamics, Jan. 12, 2026; City of Independence, Dec. 16, 2025)
Conflicts and open questions
- Building count differs: the city FAQ says up to four buildings; DCD says up to ten. Floor area is given as 2.5 million sq ft (DCD and FAQ), 2.25 million sq ft elsewhere in the FAQ and 2.1 million sq ft by KSHB (Oct. 2026).
- Bond figure: KSHB reports $150.6 billion and DCD about $150 billion; a KCTV recall story says $150 million. The city FAQ gives no amount. Abatement: DCD reports 98% real and 90% personal property; KCTV describes a 90% abatement.
- KCTV (Sept. 2026) reported that two other council members who voted for the incentives had already left office through separate elections; details not confirmed from another source.
- Construction start: May 2026 per KCTV and KSHB (Oct. 12); April per KSHB (Oct. 8).
- The outcome of the Oct. 22, 2026 hearing was not found. The suit's claims are allegations.
- Private individuals named in coverage (petition organizers, residents, plaintiffs in the referendum suit) are left out on purpose.
