Statewide
NRS 360.754, created by a 2015 bill, lets a new or expanding data center apply to the Governor's Office of Economic Development (GOED) for a 75% personal property tax abatement and a sales and use tax rate cut to 2%, for 10 years (10 Nevada-resident jobs and $25 million of capital spending within five years) or 20 years (50 jobs and $100 million); cutting the sales tax rate to 2% takes a two-thirds vote of the GOED board, and half of the construction workforce must live in Nevada. (Governor's Office of Economic Development, Aug. 1, 2025; The Nevada Independent, March 29, 2026) The Nevada Independent counted about $457 million (later $461 million) in projected data center abatements approved since 2015, roughly three-quarters for Storey County projects, and found local governments gave up over $537 million of sales and use tax revenue across eight years, measured gross; these are projected or forgone amounts, not payments. It also reported that GOED lets abated companies largely decide whether completed audits are released. (The Nevada Independent, March 29, 2026; The Nevada Independent, March 29, 2026; The Nevada Independent, Sept. 2, 2026) In 2025 the Legislature gave the GOED board power to deny a data center abatement, approve a smaller one or attach conditions; until July 2025 the board had to approve any applicant that pledged to meet the statutory tests. The bill number was not found in the sources reviewed. The Indy reported about $50 million in projected data center abatements approved since the change. (KSNV News 3, Sept. 18, 2026; The Nevada Independent, Sept. 18, 2026; The Nevada Independent, Sept. 15, 2026) Executive Order 2026-005 (Gov. Joe Lombardo, reported Sept. 18, 2026) bars GOED from bringing a data center abatement to its board unless the applicant pays all of the Local School Support Tax, keeps its combined sales-and-use rate at 4.6% or more and signs a Nevada Community Support Commitment to meet local water standards, cover its own electricity costs and cut use in declared grid emergencies; it also bars applicants controlled by foreign adversaries, asks the Office of Energy for a power plan by Dec. 31, 2026, and does not reach abatements already approved. (KSNV News 3, Sept. 18, 2026; The Nevada Independent, Sept. 18, 2026) For the 2027 session: on Aug. 26, 2026, the Joint Interim Standing Committee on Revenue took up Sen. Dina Neal's request for a bill (a proposal, not yet drafted) to repeal NRS 360.754 and impose a statewide moratorium on new or expanded data centers, and KTNV and the Indy reported the request passed with two Republican members opposed; on Sept. 1, 2026, Storey County sent the Legislature its own proposal to shorten abatements to five or 10 years, tighten spending requirements, let Clark and Washoe local governments block an abatement, bar abatements on federal land and require water and power disclosures. (Nevada Legislative Counsel Bureau, Aug. 26, 2026; KTNV Channel 13, Sept. 1, 2026; The Nevada Independent, Sept. 2, 2026) PUCN docket 24-05023: NV Energy (Sierra Pacific Power) proposed a Clean Transition Tariff in 2024 under which Google pays a premium for 115 MW of Fervo Energy's Corsac Station geothermal output to serve its Nevada data centers; trade press reported the commission approved the tariff in May 2025. Google's companion energy supply agreement was filed June 7, 2024, in a separate docket whose number was not found in the sources reviewed. (American Public Power Association, June 16, 2024; Utility Dive, June 21, 2024; ThinkGeoEnergy, May 19, 2025) PUCN docket 26-05007: NV Energy's 2027-2046 integrated resource plan (filed May 7, 2026) reports about 22 GW of large-load inquiries and about 6 GW of signed large-load agreements, projects data centers rising from about 5% of sales to 64% by 2046, and asks the commission to make Large Load Electric Service Agreements mandatory for customers of 25 MW or more so they bear the cost of serving them; the commission had not ruled as of mid-September 2026. (Public Utilities Commission of Nevada, Oct. 20, 2026; New Project Media, June 23, 2026; The Nevada Independent, Sept. 16, 2026; The Nevada Independent, July 28, 2026) Individual Large Load Electric Service Agreements filed at the PUCN in 2026 (pending): 26-05026 (Amazon Data Services), 26-05027 (Fleet Data Centers' PR RNO and SV RNO entities), 26-05028 (Vantage Data Centers NV11), 26-05029 (Novva Las Vegas and Proton NLV) and 26-05030 (Prologis, as VIP Landco, for southern Nevada sites); New Project Media reported 25-year terms, minimum bills and customer-specific generation charges. (Public Utilities Commission of Nevada, Oct. 20, 2026; New Project Media, June 23, 2026) NV Energy told The Nevada Independent in March 2026 that data center load puts it on track to miss Nevada's renewable portfolio standard (50% by 2030) for the first time, and that it planned to lean more on natural gas; the utility says it requires data center developers to fund their own infrastructure and energy. (The Nevada Independent, March 12, 2026) Water: the Indy reported that new data centers in southern Nevada have been barred from evaporative cooling since 2023, so newer southern projects use closed-loop or air cooling; no statewide water rule for data centers was found. In northern Nevada, the Indy reported in 2017 on a proposed 13-mile pipeline to carry treated Reno-Sparks wastewater to the Tahoe-Reno Industrial Center for Tesla, Switch and possibly Google, with the cities given equivalent water rights to keep Truckee River flows; the river ends at Pyramid Lake, within the Pyramid Lake Paiute Tribe's boundaries.
